การบริจาคเงิน ความต่างของบัญชีและภาษีที่ นักบัญชี และ ผู้ประกอบการควรทราบ

เมื่อผู้ประการ บริจาคเงิน สิ่งของ หรือ ทรัพย์สิน ให้กับหน่วยงานที่เข้าเงื่อนไข สามารถขอคืนภาษีได้หรือไม่ และจะได้รับสิทธิประโยชน์อะไรบ้าง  มีเงื่อนไขใดที่ต้องพิจารณาเพื่อประโยชน์สูงสุด และนักบัญชีต้องสื่อสารกับผู้ประกอบการและผู้ที่เกี่ยวข้องอย่างไร วันนี้ บริษัท ทำบัญชี M.F.N.Accounting จะช่วยให้คุณจัดทำบัญชีได้อย่างถูกต้องตามมาตรฐานบัญชี

นักบัญชี ทุกท่านทราบเป็นอย่างดีว่าบริษัทหรือห้างหุ้นส่วนนิติบุคคลต้องมีการจัดทำบัญชีตามมาตรฐานบัญชี เมื่อได้กำไรสุทธิทางบัญชีแล้ว ในการจะนำกำไรสุทธิมาคำนวณภาษีจะต้องมีการปรับปรุงให้เป็นกำไรสุทธิตามหลักเกณฑ์ตามกฎหมายภาษีก่อน ซึ่งการปรับปรุงดังกล่าวนี้เกิดจากความแตกต่างของมาตรฐานการบัญชีและภาษีในการรับรู้รายได้และรายจ่าย

หลักความแตกต่างของมาตรฐานการบัญชีและภาษีในการรับรู้รายได้และรายจ่าย

การปรับปรุงกำไรสุทธิตามหลักเกณฑ์ตามกฎหมายภาษีนั้น มักจะมีความแตกต่างของมาตรฐานการบัญชีและภาษีในการรับรู้รายได้และรายจ่าย โดยหลักความต่างดังกล่าวเกิดจากหลายปัจจัยประการ อันได้แก่ 

  1. รายได้ทางบัญชีไม่เป็นรายได้ทางภาษี
  2. รายได้ทางบัญชีไม่รับรู้ แต่ถือเป็นรายได้ทางภาษี
  3. รายจ่ายทางบัญชีถือเป็นรายจ่ายทางภาษีไม่ได้
  4. ไม่เป็นรายจ่ายทางบัญชีแต่ภาษีถือเป็นรายจ่ายได้หรือถือเป็นรายจ่ายได้มากกว่าที่จ่ายจริง
  5. บัญชีรับรู้รายได้รายจ่ายเช่นเดียวกับภาษีแต่คนละรอบระยะเวลาบัญชี

ในที่นี้จะกล่าวถึงความต่างในข้อที่สี่ เป็นรายจ่ายที่หักเป็นรายจ่ายทางภาษีได้มากกว่าที่จ่ายจริง ซึ่งในทางบัญชีจะรับรู้รายจ่ายตามหลักฐานการจ่ายจริงเพียงเท่านั้น ในทางภาษีจึงต้องทำการปรับปรุงกำไรสุทธิทางภาษี โดยการหักรายจ่ายเพิ่มเติมตามที่กฎหมายภาษีอนุญาต รายจ่ายในทางภาษีที่หักได้มากกว่าหนึ่งเท่าของที่จ่ายจริง มีหลายประเภทขึ้นอยู่กับแต่ละช่วงเวลาที่ภาครัฐจะมีมาตรการให้มีการจ่ายเงินประเภทใดก็จะมีกฎหมายให้สิทธิประโยชน์ด้านภาษีโดยให้หักรายจ่ายได้มากกว่าจ่ายจริงในช่วงระยะเวลาหนึ่ง

ตัวอย่าง รายจ่ายจากการ บริจาคเงิน เพื่อการศึกษา

รายจ่ายการ บริจาคเงิน เพื่อการศึกษา นั้น กรมสรรพากรมีการออกพระราชกฤษฎีกาให้หักเป็นรายจ่ายได้สองเท่ามาเป็นระยะๆ โดยในเดือนกันยายน 2563 ได้มีการออกพระราชกฤษฎีกาว่าด้วยการยกเว้นรัษฎากร (ฉบับที่ 173) พ.ศ. 2563 บัญญัติให้การ บริจาคเงิน เพื่อการศึกษาของนิติบุคคล สามารถหักเป็นรายจ่ายได้สองเท่าสำหรับการบริจาคในช่วงระยะเวลาตั้งแต่วันที่ 1 มกราคม 2563 ถึง 31 ถึงธันวาคม 2563 และการบริจาคเงินต้องเป็นไปตามเงื่อนไขดังนี้

  1. ต้องบริจาคเงินผ่านระบบบริจาคอิเล็กทรอนิกส์
  2. สถานศึกษาที่บริจาคต้องเป็นสถานศึกษาเหล่านี้เท่านั้น
    1. สถานศึกษาของรัฐ
    2. โรงเรียนเอกชนตามกฎหมายว่าด้วยโรงเรียนเอกชน แต่ไม่รวมถึงโรงเรียนนอกระบบตามกฎหมายว่าด้วยโรงเรียนเอกชน
    3. สถาบันอุดมศึกษาเอกชนตามกฎหมายว่าด้วยสถาบันอุดมศึกษาเอกชน
    4. สถานศึกษาที่จัดตั้งขึ้นในประเทศไทยตามสนธิสัญญาหรือความตกลงระหว่างรัฐบาลไทยกับทบวงการชำนัญพิเศษแห่งสหประชาชาติ
  3. นำรายจ่ายบริจาคเพื่อการศึกษานี้รวมกับ เงินบริจาค เพื่อสาธารณะกุศลการศึกษา การกีฬาตามหักรายจ่ายทางภาษีอื่นๆแล้วต้องไม่เกินร้อยละสิบของกำไรสุทธิก่อนหักรายจ่าย เพื่อการกุศลสาธารณะหรือเพื่อการสาธารณประโยชน์ และรายจ่ายเพื่อการศึกษาหรือเพื่อการกีฬาตามกฎหมายภาษี

นอกจากการให้หักเป็นรายจ่ายได้สองเท่าในด้านภาษีเงินได้นิติบุคคลแล้ว เพื่อเป็นการจูงใจให้มีการสนับสนุนการศึกษาอย่างต่อเนื่อง ในพระราชกฤษฎีกาดังกล่าวจึงบัญญัติให้ยกเว้นภาษีมูลค่าเพิ่ม ภาษีธุรกิจเฉพาะ และอากรแสตมป์สำหรับการบริจาคเงิน หรือทรัพย์สินให้แก่สถานศึกษาในกรณีดังกล่าวด้วย

แนวปฏิบัติที่นักบัญชี ควรทราบเพื่อการจัดทำบัญชีที่อย่างถูกต้องตามมาตรฐานบัญชี

เมื่อวันที่ 30 ตุลาคม 2563 กรมสรรพากรได้มีการออกประกาศอธิบดีกรมสรรพากร ฉบับที่ 24 เรื่อง กำหนดหลักเกณฑ์ วิธีการ และเงื่อนไขเพื่อการยกเว้นภาษีเงินได้ ภาษีมูลค่าเพิ่ม ภาษีธุรกิจเฉพาะ และ อากรแสตมป์ สำหรับการบริจาคเงินให้แก่สถานศึกษาผ่านระบบบริจาคอิเล็กทรอนิกส์ กำหนดให้การบริจาคเป็นทรัพย์สินหรือสินค้าของบริษัทหรือห้างหุ้นส่วนนิติบุคคลจะต้องเป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไข ดังนี้

  1. กรณีที่สื่อทรัพย์สินมาเพื่อบริจาค ต้องมีหลักฐานการได้มาซึ่งทรัพย์สินที่ระบุจำนวนและมูลค่าต้นทุนของทรัพย์สินนั้น โดยให้ถือว่ามูลค่าตามหลักฐานดังกล่าวเป็นมูลค่าของรายจ่ายที่บริจาค
  2. กรณีที่นำทรัพย์สินที่ได้บันทึกบัญชีทรัพย์สินนั้นมาบริจาค ให้ถือเอามูลค่าส่วนต้นทุนที่เหลือจากการคำนวณหักค่าสึกหรอและค่าเสื่อมราคาของทรัพย์สินเป็นมูลค่าของรายจ่ายที่บริจาค
  3. กรณีที่นำสินค้ามาบริจาค ไม่ว่าจะเป็นสินค้าที่ผลิตเอง หรือที่ซื้อมาเพื่อขาย ให้ถือเอามูลค่าต้นทุนของสินค้าดังกล่าวที่มีเอกสารหลักฐานสามารถพิสูจน์ได้ เป็นมูลค่าของรายจ่ายที่บริจาค แต่มูลค่าดังกล่าวต้องไม่เกินราคาสินค้าคงเหลือยกมา ตามมาตรา 65 ทวิ (6) แห่งประมวลรัษฎากร (4) มูลค่าของทรัพย์สินหรือสินค้าที่ซื้อมาเพื่อบริจาคนั้น จะต้องมีจำนวนไม่เกินราคาที่พึงซื้อได้โดยปกติ

เงินบริจาค

นักบัญชี ต้องใช้สิทธิหักรายจ่ายสองเท่าสำหรับมูลค่าการนำสินค้าหรือ ทรัพย์สินของบริษัทไปบริจาคตามแนวข้างต้น และควรแจ้งให้ผู้รับบริจาคได้ดำเนินการในระบบ e-Donation ให้มีมูลค่าตรงตามเกณฑ์ อนึ่งประกาศอธิบดีกรมสรรพากรฉบับที่ 24 อนุญาตให้ใช้ข้อมูลการบริจาคที่ปรากฏในระบบบริจาคอิเล็กทรอนิกส์เป็นหลักฐานประกอบการใช้สิทธิโดยไม่ต้องแสดงเอกสารหลักฐานการบริจาคเงิน การบริจาคได้สิทธิการหักรายจ่ายสองเท่า จึงเป็นความต่างของบัญชีและภาษีที่เป็นคุณ อย่างไรก็ตามให้ดำเนินการตามเงื่อนไขที่กฎหมายกำหนดให้ถูกต้องครบถ้วนด้วย หากผิดพลาดไปอาจต้องชำระภาษีเพิ่มพร้อมเบี้ยปรับเงินเพิ่ม
