ภาษีจากการให้บริการกิจการท่องเที่ยว
หลังจากเริ่มเปิดประเทศสภาพเศรษฐกิจเหมือนกำลังดีขึ้นกว่าเดิม ชาวต่างชาติเดินทางเข้ามาท่องเที่ยวในประเทศไทยค่อนข้างมาก อีกทั้งคนไทยก็มีการท่องเที่ยวในประเทศมากขึ้น ทำให้กิจการที่เกี่ยวเนื่องกับการท่องเที่ยวเริ่มขยับดีขึ้นไปด้วยไม่ว่าจะเป็นธุรกิจโรงแรม ตัวแทนท่องเที่ยว ตัวแทนขายตั๋วเครื่องบิน ตัวแทนที่เกี่ยวข้องกับธุรกิจท่องเที่ยวรวมถึงสินค้าที่ระลึกของฝากต่าง ๆ จึงควรเตรียมพร้อมสำหรับการจัดการด้านบัญชีเพื่อลดภาระค่าใช้จ่ายจาก ภาษีท่องเที่ยว
นิยามศัพท์ที่เกี่ยวกับการจัดการ ภาษีท่องเที่ยว
” ภาษีการท่องเที่ยว (Tourism Tax) “ เป็นหนึ่งในแหล่งรายได้ของภาครัฐที่ช่วยลดแรงกดดันทางการคลัง และทำให้ภาครัฐมีรายได้สำหรับการลงทุนสาธารณะในสิ่งอำนวยความสะดวก บริการ และสิ่งต่างๆ ที่สนับสนุนการ พัฒนาการท่องเที่ยวทั้งในระดับประเทศและท้องถิ่น เพื่อให้สามารถรองรับการขยายตัวของการท่องเที่ยวที่อาจ เกิดขึ้นในอนาคต รวมทั้งช่วยเสริมสร้างความสามารถในการแข่งขันด้านการท่องเที่ยวให้กับประเทศ
“อุตสาหกรรมท่องเที่ยว” หมายความว่า อุตสาหกรรมที่จัดให้มีหรือให้บริการเกี่ยวกับการท่องเที่ยวทั้งภายในและภายนอกราชอาณาจักรโดยมีค่าตอบแทน และหมายความรวมถึง
- ธุรกิจนำเที่ยว
- ธุรกิจโรงแรมนักท่องเที่ยว
- ธุรกิจภัตตาคาร สถานบริการ และสถานที่ตากอากาศสำหรับนักท่องเที่ยว
- ธุรกิจการขายของที่ระลึกหรือสินค้าสำหรับนักท่องเที่ยว
- การกีฬาสำหรับนักท่องเที่ยว
- การดำเนินงานนิทรรศการ งานแสดง งานออกร้าน การโฆษณาเผยแพร่ หรือการดำเนินงานอื่นใดโดยมีความมุ่งหมายเพื่อชักนำหรือส่งเสริมให้มีการเดินทางท่องเที่ยว
“ผู้ประกอบอุตสาหกรรมท่องเที่ยว” หมายความว่า ผู้ดำเนินธุรกิจอุตสาหกรรมท่องเที่ยว
“นักท่องเที่ยว” หมายความว่า บุคคลที่เดินทางจากท้องที่อันเป็นถิ่นที่อยู่โดยปกติของตนไปยังท้องที่อื่นเป็นการชั่วคราว ด้วยความสมัครใจและด้วยวัตถุประสงค์อันมิใช่เพื่อไปประกอบอาชีพหรือหารายได้
อย่างไรก็ตามอย่าลืมว่า ผู้ประกอบการท่องเที่ยวหรือกิจการที่เกี่ยวเนื่องกับการท่องเที่ยวนั้นมีภาระภาษีท่องเที่ยวที่เกิดขึ้นกับธุรกิจไม่ว่าจะเป็นภาษีเงินได้ ภาษีเงินได้หัก ณ ที่จ่าย หรือภาษีมูลค่าเพิ่ม อันเป็นประเด็นที่ผู้ประกอบการจะต้องระมัดระวังไม่ให้มีความผิดพลาดได้
ภาษีอากรที่สำคัญสำหรับกิจการให้บริการท่องเที่ยว
ภาษีการท่องเที่ยว เป็นภาษีที่ใช้เฉพาะสำหรับนักท่องเที่ยวและอุตสาหกรรมท่องเที่ยว หรืออาจใช้กับจุดหมายปลายทางด้านการท่องเที่ยวที่เป็นคู่แข่ง” จากนิยามดังกล่าวมีข้อสังเกตและข้อโต้แย้งที่สำคัญว่า สินค้าและบริการหลายรายการอาจถูกบริโภคและใช้โดยทั้งนักท่องเที่ยวและไม่ใช่นักท่องเที่ยว ดังนั้นรายการภาษีบางรายการที่เรียก เก็บจากนักท่องเที่ยวอาจไม่เกี่ยวข้องกับกิจกรรมการท่องเที่ยว และบางรายการไม่ได้กำหนดฐานภาษี (Tax Base) จากกิจกรรมการท่องเที่ยว ดังนั้น ภาษีการท่องเที่ยว จึงจัดเป็นภาษีทางอ้อม (Indirect Taxes) ค่าธรรมเนียม (Fee) และค่าบริการพิเศษ (Charge) ที่ส่งผลกระทบต่อกิจกรรมที่เกี่ยวข้องกับการท่องเที่ยว เช่น ภาษีอากรทั่วไป (ภาษีมูลค่าเพิ่ม ภาษีนำเข้า ภาษีการขาย) ภาษีธุรกิจเฉพาะ (ภาษีโรงแรม ภาษีสนามบิน ค่าธรรมเนียมวีซ่า)
1. ภาษีเงินได้บุคคลธรรมดา และ ภาษีเงินได้นิติบุคคล
เงินได้ที่ผู้ประกอบกิจการได้รับต้องนำไปเสียภาษีเงินได้ ดังนี้
1.1. ภาษีเงินได้บุคคลธรรมดา
ภาษีเงินได้บุคคลธรรมดา แยกพิจารณาจากรายได้ดังกล่าวออกเป็น 3 ส่วน ดังนี้

- รายได้ค่าบริการ บุคคลธรรมดาที่มีเงินได้จะเลือกเสียภาษีได้ 2 วิธีคือ หักค่าใช้จ่ายตามที่เกิดขึ้นจริง หรือ หักค่าใช้จ่ายเป็นการเหมาร้อยละ 60 บุคคลธรรมดาต้องยื่นเสียภาษีปีละ 2 ครั้ง ก็คือ ภงด.94 (กลางปี) และ ภง.ด.90 (ปลายปี)
- รายได้ค่านายหน้า ถือเป็นเงินไว้ตามมาตรา 40 (2) บุคคลธรรมดาที่มีเงินได้จะเสียภาษีโดยวิธีหักค่าใช้จ่ายเป็นการเหมาร้อยละ 50 แต่ต้องไม่เกิน 100,000 บาท และบุคคลธรรมดาต้องยื่นเสียภาษี ภ.ง.ด.90 (ปลายปี)
- รายได้อื่น เฉพาะรายได้จากการขายของที่ระลึก ถือเป็นเงินได้ตามมาตรา 40 (8) และรายได้จากการรับทำวีซ่าและหนังสือเดินทาง ถือเป็นเงินได้ 40 (2) ซึ่งการคำนวณจะเหมือนกับรายได้ค่าบริการ และ รายได้ค่านายหน้า
สำหรับรายได้เงินปันผลและดอกเบี้ยหากบุคคลธรรมดาได้รับเงินและถูกหักภาษีเงินได้ ณ ที่จ่าย แล้ว สามารถเลือกเสียภาษีเงินได้ 2 วิธี ก็คือ จะนำไปรวมหรือไม่นำไปรวมเงินได้อื่นในการคำนวณภาษีงินได้ปลายปีก็ได้
1.2. ภาษีเงินได้นิติบุคคล
หากผู้ประกอบกิจการบริษัทหรือห้างหุ้นส่วนนิติบุคคลประกอบกิจการให้บริการท่องเที่ยว เมื่อมีเงินได้เกิดขึ้นจะต้องเสียภาษีเงินได้ของนิติบุคคลตามมาตรา 65 แห่งประมวลรัษฎากร ที่ได้กำหนดไว้ดังนี้
เงินได้ที่ต้องเสียภาษีในส่วนที่เป็นกำไรสุทธิ ซึ่งคำนวณได้จากรายได้หักรายจ่าย
การคำนวณรายได้และรายจ่ายให้ใช้ “เกณฑ์สิทธิ” โดยให้นำรายได้ที่เกิดขึ้นในรอบระยะเวลาบัญชีใด แม้ว่าจะยังไม่ได้รับชำระในรอบระยะเวลาบัญนั้น มารวมคำนวณเป็นรายได้ในรอบระยะเวลาบัญชีนั้น และให้นำรายจ่ายทั้งสิ้นที่เกี่ยวกับรายได้นั้น แม้จะยังมิได้จ่ายในรอบระยะเวลาบัญชีนั้น มารวมคำนวณเป็นรายจ่ายของรอบระยะเวลาบัญชีนั้น โดยจะต้องคำนวณกำไรสุทธิเพื่อเสียภาษีเงินได้นิติบุคคลโดยการยื่นแบบปีละ 2 ครั้ง คือ ภง.ด.51 (กลางปี) และ ภ.ง.ด.50 (ปลายปี)
2. ภาษีเงินได้หัก ณ ที่จ่าย
เมื่อผู้ประกอบการกิจการท่องเที่ยวทั้งที่เป็นบุคคลธรรมดาหรือนิติบุคคล เมื่อมีรายได้จะถูกผู้จ่ายเงิน เฉพาะที่เป็นบริษัทหรือห้างหุ้นส่วนนิติบุคคลมีหน้าที่หักภาษีเงินได้ ณ ที่จ่าย ค่าบริการท่องเที่ยวต่าง ๆ นำส่งกรมสรรพากร
3. ภาษีมูลค่าเพิ่ม
ผู้ประกอบการที่มีรายได้ต่อปีเกิน 1.8 ล้านบาทต่อปี มีหน้าที่ต้องจดทะเบียนและเสียภาษีมูลค่าเพิ่ม โดยผู้ประกอบการจดทะเบียนมีหน้าที่ต้องออกใบกำกับภาษีและรายงานภาษีมูลค่าเพิ่มภายใน 3 วันทำการ และต้องยื่นแบบภาษีมูลค่าเพิ่ม (ภ.พ.30) ภายในวันที่ 15 ของเดือนถัดไป
3.1 ภาษีท่องเที่ยว และการเสียภาษีมูลค่าเพิ่มของการประกอบธุรกิจ
จุดรับผิดในการเสียภาษีมูลค่าเพิ่มของการประกอบธุรกิจที่เกิดจากการให้บริการท่องเที่ยวและกิจการที่เกี่ยวเนื่อง มีดังนี้
3.1.1 การขายสินค้า ความรับผิดทั้งหมดเกิดขึ้นเมื่อส่งมอบสินค้า เว้นแต่กรณีที่ได้มีการ โอนกรรมสิทธิ์สินค้า การได้รับชำระราคาสินค้า หรือและการออกใบกำกับภาษีที่เกิดขึ้นก่อนส่งมอบสินค้า
3.1.2. การให้บริการ ความรับผิดทั้งหมดเกิดขึ้นเมื่อได้รับชำระค่าบริการ เว้นแต่มีเมื่อมีการออกใบกำกับภาษี และ ใช้บริการไม่ว่าโดยตนเองหรือบุคคลอื่นก่อนได้รับชำระค่าบริการ ก็ให้ถือว่าความรับผิดเกิดขึ้นเมื่อได้มีการกระทำนั้นๆ ด้วย
ผู้ประกอบการจดทะเบียนต้องจัดทำใบกำกับภาษีและสำเนาใบกำกับภาษีสำหรับการขายสินค้าหรือการให้บริการทุกครั้ง พร้อมทั้งให้ส่งมอบใบกำกับภาษีนั้นแก่ผู้ซื้อสินค้าหรือผู้รับบริการใบกำกับภาษีให้เก็บรักษาไว้
3.2. แนวปฏิบัติในการเสียภาษีมูลค่าเพิ่มและภาษีเงินได้หัก ณ ที่จ่าย
กรมสรรพากรได้วางแนวปฏิบัติในการเสียภาษีมูลค่าเพิ่มและภาษีงินได้หัก ณ ที่จ่ายไว้ที่หนังสือกรมสรรพากรที่ กค 0811/11473 ลงวันที่ 12 ธันวาคม 2544 สรุปได้ดังนี้
การเสียภาษีมูลค่าเพิ่มและการหักภาษีเงินได้ ณ ที่จ่าย
การเสียภาษีที่เกี่ยวข้องกับ ภาษีท่องเที่ยว อย่างการเสียภาษีมูลค่าเพิ่ม และ การหักภาษีเงินได้ ณ ที่จ่าย นั้น ได้จัดแบ่งเป็น 3 กรณีด้วยกัน คือ กรณีแรกเป็นกรณีที่ตัวแทนให้บริการสำรองห้องพักโรงแรม กรณีที่สองเป็นกรณีที่ผู้ประกอบการประกอบกิจการนำเที่ยว และ กรณีสุดท้ายเป็นกรณีการให้บริการเป็นตัวแทนขายตั๋วโดยสาร ซึ่งเป็นละกรณีจะ
1. กรณีเป็นตัวแทนให้บริการสำรองห้องพักโรงแรม
การเสียภาษีมูลค่าเพิ่มและการหักภาษีเงินได้ ณ ที่จ่าย ในกรณีเป็นตัวแทนให้บริการสำรองห้องพักโรงแรมนั้น ยังสามารถแบ่งแยกย่อยได้อีก 3 แบบ คือ
1.1 ตัวแทนหรือตัวแทนช่วงให้บริการสำรองห้องพักโรงแรมแก่ผู้ใช้บริการ
ตัวแทนหรือตัวแทนช่วงให้บริการสำรองห้องพักโรงแรมแก่ผู้ใช้บริการทั้งกรณีการสำรองห้องพักโรงแรมในประเทศและต่างประเทศ ถือว่าโรงแรมให้บริการห้องพักแก่ผู้ใช้บริการ มิใช่โรงแรมให้บริการห้องพักแก่ตัวแทนหรือตัวแทนช่วง ดังนั้นโรงแรมในประเทศมีหน้าที่ต้องเสียภาษีมูลค่าเพิ่มตามมาตรา 77/2 (1) แห่งประมวลรัษฎากร โดยต้องออกใบกำกับภาษีให้แก่ผู้ใช้บริการด้วย
1.2 โรงแรมกำหนดค่านายหน้าไว้ในราคาห้องพักโดยเสนอเป็นราคาสุทธิ
โรงแรมกำหนดค่านายหน้าไว้ในราคาห้องพักโดยเสนอเป็นราคาสุทธิ เช่น ราคาห้องพัก 100 บาท โรงแรมเสนอราคาให้แก่ตัวแทน 95 บาท ซึ่งตัวแทนสามารถบวกค่าบริการส่วนเพิ่มขายให้แก่ตัวแทนช่วงหรือผู้ใช้บริการ ตัวแทนอาจขายให้แก่ตัวแทนช่วง 97 บาท และตัวแทนช่วงขายต่อให้แก่ผู้ใช้บริการในราคา 100 บาท เมื่อโรงแรมเก็บเงินจากตัวแทน 95 บาท ถือว่าโรงแรมได้จ่ายค่าบำเหน็จตัวแทนให้แก่ตัวแทน โดยคำนวณจากผลต่างระหว่างราคาห้องพักที่ตัวแทนรับจากผู้ใช้บริการและราคาห้องพักที่จ่ายให้แก่โรงแรมจำนวน 5 บาท ซึ่งเป็นงินได้พึงประเมินตามมาตรา 40 (2) แห่งประมวลรัษฎากร หากตัวแทนเป็นบริษัทหรือห้างหุ้นส่วนนิติบุคคลที่ประกอบกิจการในประเทศไทย โรงแรมในประเทศมีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่าย ในอัตรา 3% แต่หากโรงแรมในต่างประเทศจ่ายค่าบำเหน็จตัวแทนโรงแรมในต่างประเทศ ไม่มีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่ายแต่อย่างใด และตัวแทนมีหน้าที่ต้องเสียภาษีมูลค่าเพิ่มในอัตรา 7% ของค่าบำเหน็จตัวแทนจำนวน 5 บาท ตามมาตรา 77/2 (1) และมาตรา 80 แห่งประมวลรัษฎากร
1.3 โรงแรมกำหนดค่านายหน้าแก่ตัวแทนเป็นอัตราร้อยละของราคาห้องพัก
โรงแรมกำหนดค่านายหน้าแก่ตัวแทนเป็นอัตราร้อยละ (คงที่) ของราคาห้องพัก เช่น ราคาห้องพัก 100 บาท ค่านายหน้า 5% และให้ตัวแทนจ่ายเป็นเงินยอดสุทธิให้แก่โรงแรม หรือในกรณีโรงแรมกำหนดค่านายหน้าให้แก่ตัวแทนต่างหากจากราคาห้องพัก เมื่อผู้ใช้บริการจ่ายค่าห้องพักให้แก่โรงแรมโดยตรง โรงแรมจะจ่ายคำนายหน้าให้แก่ตัวแทนเมื่อผู้ใช้บริการห้องพักเสร็จสิ้นแล้ว ถือว่าโรงแรมให้บริการห้องพักแก่ผู้ใช้บริการมีหน้าที่ต้องเสีย ภาษีท่องเที่ยว อย่างภาษีมูลค่าเพิ่มและออกใบกำกับภาษีให้แก่ผู้ใช้บริการเช่นเดียวกับ การเสียภาษีมูลค่าเพิ่มและการหักภาษีเงินได้ ณ ที่จ่าย ในกรณีเป็นตัวแทนให้บริการสำรองห้องพักโรงแรมการ หรือ ตัวแทนช่วงให้บริการสำรองห้องพักโรงแรมแก่ผู้ใช้บริการ
2. กรณีการประกอบกิจการนำเที่ยว
การเสียภาษีมูลค่าเพิ่มและการหักภาษีเงินได้ ณ ที่จ่าย ในกรณีการประกอบกิจการนำเที่ยวนั้น ยังสามารถแบ่งแยกย่อยได้อีก 3 แบบ คือ
2.1 การประกอบกิจการนำเที่ยวยังต่างประเทศ (Outbound)
การประกอบกิจการนำเที่ยวโดยรับบริการนำนักท่องเที่ยวเดินทางไปท่องเที่ยวยังต่างประเทศ (Outbound) หรือ จัดบริการนำนักท่องเที่ยวจากต่างประเทศมาท่องเที่ยวในประเทศไทย (inbound) การรับจัดนำเที่ยวดังกล่าวถือเป็นการให้บริการในราชอาณาจักรอยู่ในบังคับต้องเสียมูลค่าเพิ่ม
2.2 กรณีคิดค่าบริการนำเที่ยวเป็นการเหมา (Package Tour)
ในกรณีคิดค่าบริการนำเที่ยวเป็นการเหมา ซึ่งค่าบริการนำเที่ยวที่คิดเป็นการเหมานั้น สำหรับกรณี Outbound ประกอบด้วยค่าบริการในการทำหนังสือเดินทางและจัดทำวีซา ค่าตั๋วโดยสารเครื่องบิน ค่าบริการนำเที่ยว รวมทั้งค่าโรงแรม ค่าอาหาร และค่าขนส่ง ณ ต่างประเทศ และกรณี Inbound ประกอบด้วยค่าบริการท่องเที่ยว รวมทั้งค่าขนส่ง ค่าอาหาร ค่าบัตรผ่านประตู ค่ามัคคุทศก์ ค่าโรงแรมและค่าอาหารที่โรงแรม ค่าตั๋วโดยสารเครื่องบินภายในประเทศ เป็นต้น ผู้ประกอบการจะต้องนำค่าบริการ นำเที่ยวที่คิดเป็นการเหมาซึ่งประกอบด้วยคำบริการใดๆ ที่คิดเอาจากนักท่องเที่ยวทั้งหมดมาเป็นมูลค่าของฐานภาษีเพื่อเสียภาษีมูลค่าเพิ่ม และการให้บริการจัดนำเที่ยวดังกล่าวเข้าลักษณะเป็นการรับจ้างทำโดยหากผู้จ่ายเงินเป็นบริษัทหรือห้างหุ้นส่วนนิติบุคคลหรือนิติบุคคลอื่น ผู้จ่ายเงินมีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่าย ในอัตรา 3% ของค่าบริการนำเที่ยวที่คิดเป็นการเหมา
2.3 การประกอบกิจการนำเที่ยวยังต่างประเทศ โดยมิได้คิดค่าบริการนำเที่ยวเป็นการเหมา
ค่าบริการนำเที่ยวมิได้คิดเป็นการเหมา แต่ได้มีการตกลงกับนักท่องเที่ยวโดยขอคิดสินจ้างเฉพาะค่นำเที่ยวและค่าบริการเท่านั้น ส่วนค่าใช้จ่ายที่เกี่ยวเนื่องกับ ภาษีท่องเที่ยว ที่นักท่องเที่ยวจะต้องจ่ายเพิ่มขึ้นนอกเหนือจากสินจ้างดังกล่าว เช่น ค่าโรงแรม ค่าตั๋วโดยสารเครื่องบิน ค่าอาหารในโรงแรม ซึ่งผู้ประกอบการที่รับจัดนำเที่ยวจ่ายทดรองให้นักท่องเที่ยวแต่ละคนไปก่อน โดยจ่ายไปจริงเท่าใดก็จะเรียกเก็บคืนจากนักท่องเที่ยวเท่านั้น (Cost Plus) และถ้ามีส่วนลดใดๆ จากผู้รับคำาใช้จ่ายดังกล่าวก็จะคืนส่วนลดนั้นให้แก่นักท่องเที่ยวทั้งหมดโดยตนเองจะไม่รับเก็บไว้เป็นรายได้ของตน และผู้ประกอบการที่รับจัดนำเที่ยวได้มีหลักฐานพิสูจน์ได้อย่างชัดแจ้งปราศจากข้อสงสัยว่าได้มีการปฏิบัติเช่นนั้นจริง ผู้ประกอบการที่รับจัดนำเที่ยวมีสิทธินำเฉพาะสินจ้างที่เป็นค่านำเที่ยวและค่าบริการมารวมคำนวณเป็นมูลค่าของฐานภาษีเพื่อเสียภาษีมูลค่าเพิ่ม สำหรับคำใช้จ่ายอื่นที่นักท่องเที่ยวต้องจ่ายเพิ่มขึ้นนอกเหนือจากสินจ้าง ซึ่งผู้ประกอบการที่รับจัดนำเที่ยวได้เรียกเก็บจากนักท่องเที่ยวตามจำนวนที่ทดรองจ่ายไปจริง ไม่ต้องนำมารวมคำนวณเป็นมูลค่าของฐานกาษีเพื่อเสียภาษีมูลค่าเพิ่ม และการให้บริการรับจัดนำเที่ยวดังกล่าวเข้าลักษณะเป็นการรับจ้างทำของ
3. กรณีการให้บริการเป็นตัวแทนขายตั๋วโดยสาร
3.1. กรณีสายการบินขายตั๋วโดยสารให้กับคนโดยสารผ่านตัวแทนที่ได้รับแต่งตั้ง (Bill Settlement Plan)
กรณีสายการบินขายตั๋วโดยสารให้กับคนโดยสารหรือผู้รับบริการโดยผ่านตัวแทนที่ได้รับแต่งตั้ง หรือเรียกว่า BSP Agent (Bill Settlement Plan) ผลต่างระหว่างราคาขายตั๋วโดยสารที่ BSP Agent ขายได้ และราคาขายตั๋วโดยสารที่สายการบินเรียกเก็บจาก BSP Agent ถือเป็นค่านายหน้าที่สายการบินจ่ายให้แก่ BSP Agent สายการบินจึงมีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่าย 30% และ BSP Agent ยังมีหน้าที่ต้องเสียภาษีมูลค่าเพิ่มสำหรับคำนายหน้าดังกล่าว 7% และต้องออกใบกำกับภาษี ให้แก่สายการบินอีกด้วย
3.2. กรณีสายการบินขายตั๋วโดยสารโดยผ่าน BSP Agent และ ตัวแทนช่วงเป็นผู้ให้บริการแก่คนโดยสารโดยมิได้ให้บริการแก่ BSP Agent
ในกรณีสายการบินขายตั๋วโดยสารให้กับคนโดยสารหรือผู้รับริการโดยผ่าน BSP Agent และ BSP Agent ขายตั๋วโดยสารผ่านตัวแทนช่วง โดยตัวแทนช่วงเป็นผู้ให้บริการแก่คนโดยสารโดยมิได้ให้บริการแก่ BSP Agent ตัวแทนช่วงมี หน้าที่ต้องเสียภาษีมูลค่าเพิ่มจากมูลค่าของค่าบริการที่ได้รับจากการให้บริการซื้อตั๋วโดยสารให้แก่คนโดยสาร โดยคำนวณจากค่าบริการที่ได้เรียกเก็บจากคนโดยสาร และตัวแทนช่วงยังมีหน้าที่ต้องออกใบกำกับภาษีให้แก่คนโดยสาร โดยจะต้องระบุให้ชัดแจ้งว่าเป็นค่าบริการสำหรับการซื้อตั๋วโดยสารเลขที่ใด ของสายการบินใดและกรณีคนโดยสารหรือผู้รับบริการจ่ายค่าบริการที่เป็นค่าบำเหน็จตัวแทนให้แก่ตัวแทนช่วง หากผู้รับบริการเป็นบริษัทหรือห้างหุ้นส่วนนิติบุคคลหรือนิติบุคคลอื่น และตัวแทนช่วงเป็นบริษัทหรือห้างหุ้นส่วนนิติบุคคลที่ประกอบกิจการในประเทศไทย ผู้รับบริการซึ่งเป็นผู้จ่ายเงินมีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่าย 3%
3.3. กรณี BSP Agent เป็นผู้จำหน่ายตั๋วเอง
กรณี BSP Agent จำหน่ายตั๋วโดยสารเครื่องบินทั้งในประเทศและต่างประเทศ แล้วต่อมาผู้โดยสารยกเลิกการเดินทางผู้โดยสารจะนำตั๋วโดยสารมาให้แก่ BSP Agent เพื่อยกเลิกการเดินทางกับสายการบิน ซึ่งสายการบินจะคิดค่าปรับจากการยกเลิกการเดินทาง โดยมีการดำเนินงาน ดังนี้
กรณีตั๋วโดยสารภายในประเทศ สายการบินจะคิดค่าปรับ 200 บาท ซึ่งจะระบุไว้ในตั๋วโดยสาร เมื่อผู้โดยสารนำตั๋วมาคืนกับ BSP Agent จากนั้น BSP Agent จะส่งตั๋วโดยสารให้สายการบินตรวจสอบ แล้วจึงคืนเงินหลังจากหักค่าปรับให้แก่ BSP Agent ซึ่ง BSP Agent ก็จะส่งคืนให้แก่ผู้โดยสารต่อไป เงินค่าปรับดังกล่าวถือเป็นค่าเสียหายที่ไม่อยู่ในบังคับต้องเสียภาษีมูลค่าเพิ่มและไม่อยู่ในบังคับต้องหักภาษีงินได้ ณ ที่จ่าย
กรณีตั๋วโดยสารต่างประเทศ สายการบินจะคิดค่าปรับ 800 บาท ซึ่งจะระบุไว้ในตั๋วโดยสาร ในทางปฏิบัติผู้โดยสารนำตั๋วมาคืนกับ BSP Agent มูลค่า 10,000 บาท BSP Agent จะส่งตั๋วโดยสารให้สายการบินตรวจสอบแล้วจึงหัก 400 บาท และให้ตัวแทน 400 บาท ซึ่งหากตัวแทนขายตั๋วโดยสารให้แก่ตัวแทนช่วง ตัวแทนก็จะแบ่งเงินค่าปรับนั้นให้แก่ตัวแทนช่วง 200 บาท กรณีดังกล่าว เฉพาะในส่วนที่สายการบินหักไว้เป็นค่าปรับ 400 บาท ถือเป็นค่าเสียหายที่ไม่อยู่ในบังคับต้องเสียภาษีมูลค่าเพิ่ม และไม่อยู่ในบังคับต้องหักภาษีเงินได้ ณ ที่จ่าย แต่ในสวนที่สายการบินแบ่งให้แก่ตัวแทนถือเป็นการจ่ายค่าบำเหน็จตัวแทน สายการบินมีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่าย ในอัตรา 3% และหากตัวแทนแบ่งเงินค่าปรับให้ตัวแทนช่วงตัวแทนจ่ายค่าบำเหน็จตัวแทนให้แก่ตัวแทนช่วง ตัวแทนมีหน้าที่ต้องหักภาษีเงินได้ ณ ที่จ่าย เช่นเดียวกัน
